ARTICLE 1: Introduction
The website https://www.aventurenordique.com is published by AVENTURE NORDIQUE SARL, whose registered office is at 586 Route de Villard 38250 Lans-en-Vercors France, and which is registered on the Grenoble Trade and Companies Register under the number 524 610 243, and whose VAT number is FR FR18524610243, telephone number 04 76 39 79 67 represented by its manager Mr Régis CAHN, hereafter called “AVENTURE NORDIQUE”.
The website https://www.aventurenordique.com offers outdoor sports equipment, mountain equipment and equipment for the great outdoors for sale.
ARTICLE 2: Definitions
The following terms used in these General Terms and Conditions of Sale have the following meanings:
- Customer: means the physical person who buys the Product(s) on Aventure Nordique’s website for a personal private and non-professional use.
- Confirmation of availability: e-mail sent to the Customer confirming the availability of the Product and its effective delivery.
- Customer account: means the account that users can open on the website, notably in order to purchase one or more Products, and which contains personal information about them and their order history.
- Product(s): means the product or products offered for sale by Aventure Nordique on the website.
- Website: means the website https://www.aventurenordique.com operated by AVENTURE NORDIQUE.
- User: means any physical person using the website.
ARTICLE 3: Purpose
These General Terms and Conditions of Sale govern the contractual relationship between the Customer and AVENTURE NORDIQUE, within the framework of the sale of Products on the website, and in particular they set out the terms and conditions for ordering, payment, and delivery.
The Customer is required to read these General Terms and Conditions of Sale carefully before purchasing a Product or Products on the website. These General Terms and Conditions contain important information about the Customer's rights and obligations.
The fact that the Customer confirms the order of a Product or Products on the website entails complete and unreserved acceptance of these General Terms and Conditions of Sale. The Customer expressly accepts this, in particular by ticking the box designated for this purpose during the online ordering process.
The General Terms and Conditions of Sale are accessible at all times on the website.
ARTICLE 4: The binding nature of these general terms and conditions of sale
These General Terms and Conditions of Sale take effect from the date they are published online. The version that is binding for the Customer is the version that they accepted on the website when their order was confirmed.
Each purchase on the website is governed by the General Terms and Conditions of Sale that apply on the date of the order.
The different versions of the General Terms and Conditions of Sale are archived in paper, PDF, and Word format on a secure, remote server.
AVENTURE NORDIQUE reserves the right to modify these provisions at any time. These modifications or adaptations are binding on the Customer as soon as they are published online and cannot be applied to orders which are placed at an earlier date.

The main characteristics of the Product, in particular the illustrations and specifications of its dimensions, composition, origin, use and its suitability for use, are presented on the description sheet for each Product and in special sections of the website.
The Products are described as accurately as possible.
The Customer should read these descriptions before placing an order, as the choice and purchase of a Product is the Customer's sole responsibility.
Product offers are valid as long as they are displayed on the website, subject to availability, as specified during the ordering process.

ARTICLE 7: The Procedure for Ordering
7.1 Creation of a customer account
Users who wish to place an order on the website must open a customer account and provide the information requested on the online form and choose a password.
The Customer, when creating the customer account, undertakes to provide accurate information concerning his or her civil status, contact details, e-mail and postal addresses and telephone number. The Customer is responsible for updating the information provided, which can be modified by the Customer logging on to his or her account.
Likewise, the Customer is exclusively responsible for the protection and confidentiality of his or her password.
7.2 Stages of the order
Users who wish to purchase one or more Products must follow this procedure on the website:

Select the desired Product.

Choose the size of the Product.

Choose the colour/size of the Product, etc.

Specify the quantity of the desired Product.

Add the Product to the basket.

Confirm the contents of the basket once all the desired Products have been added.

Create a customer account if one has not already been created, or log in using your customer account details.

Choose the desired delivery method.

Choose the payment method.

If applicable, opt to use an Aventure Nordique gift card to pay for all or part of the order.

Check the details of the order and correct them if necessary.

Apply a promo code if the User has one, and wishes to use it

Confirm acceptance of the General Terms and Conditions of Sale in force on the day of the order by ticking the box provided for this purpose ‘I have read and accept the general terms and conditions of sale.’

Validate the payment and confirm the order with the obligation to pay by clicking on the “CONFIRM MY ORDER” button.
The Customer is solely responsible for the choice of Products and their suitability for their needs, and Aventure Nordique cannot be held liable in this respect.
Any total or partial inability to use the Products, notably as a result of incompatibility, shall not give rise to any compensation, refund, or liability on the part of Aventure Nordique, apart from any legal obligation to do so.
Article 8: Terms of payment
8.1 Payment method
Orders placed by the Customer can be paid for by:
- Credit card issued in France.
- PayPal.
- Bank transfer, in which case the order is sent by AVENTURE NORDIQUE after receipt of payment in its bank account.
The payment methods available are listed on the website and may vary from country to country.
Payment is made via 3D Secure. The online payment system is secure and encrypts the transmission of your bank details.
The Customer can opt to pay in 3 or 4 instalments at no extra cost when placing the order. The COFIDIS financing system allows the Customer to pay for an order from €150 to €2500 with a French card that covers the financing period. This option requires the Customer to be domiciled and delivered in France.
8.2 Aventure Nordique GIFT CARD
An order can be paid for in full or in part with one or more AVENTURE NORDIQUE gift cards.
Gift cards can be combined and used on discounted items and during sales.
They are valid for one year and cannot be returned or exchanged.
8.3 Promo code
The Customer may benefit from a Promo Code entitling them to a reduction on the price to be paid.
Promo Codes have a limited validity period. This is stated on the Promo Code and/or the website.
8.4 Retention of title clause
The Products ordered by the Customer remain AVENTURE NORDIQUE's property until the total amount of the order has been paid. This ownership entitles AVENTURE NORDIQUE to repossess the Products if the Customer fails to pay the total amount owed.
ARTICLE 9: Confirmation of the order
Once the order has been placed, AVENTURE NORDIQUE will send the Customer an email confirming the order, which includes the information concerning the Products ordered, their price and the delivery charges.
In addition, the Customer can go to ‘My Account,’, and then to ‘my orders’ and click on the order in question to obtain details of the order.
AVENTURE NORDIQUE reserves the right to refuse or cancel a Customer’s order for any justified reason, especially in the following cases:

refusal of payment by the Customer's bank.

fraudulent use of payment methods or any other similar criminal offence by the Customer.
-
non-existent delivery information.
ARTICLE 10: Delivery
10.1 Contents of the delivery
The product(s) ordered are delivered and include instructions for use when this is necessary.
10.2 Place of delivery
AVENTURE NORDIQUE delivers the Products in mainland France, Monaco, the French overseas departments, and territories, and all the countries listed on the website on the date of the order. For deliveries outside mainland France, it is advisable to check the delivery charges, when ordering, as these vary depending on the country and the weight of the Products to be delivered.
10.3 Delivery methods
Delivery is made, as the Customer, chooses by Colissimo, Chronopost, DPD or GLS, either to a pick-up point or home delivery, according to the prices displayed on the website before the order is confirmed. The Customer can also choose to collect the order from the shop at 586 Route de Villard, 38250 Lans-en-vercors.
10.4 Delivery deadlines
The Products will be delivered on the date or within the deadline stated to the Customer on the order confirmation page and, if no date is stated, no later than thirty (30) days from the date on which the Customer placed the order.
The Customer shall have the option to cancel the order if delivery does not take place on the date or by the deadline specified, or if no delivery is made within thirty days of placing the order, except in the case of force majeure. The Customer can therefore cancel the order, after having instructed AVENTURE NORDIQUE by recorded delivery letter with acknowledgement of receipt or in writing on a permanent medium, to make the delivery within a reasonable additional period, if the delivery has not been made within this period.
If the order is cancelled, AVENTURE NORDIQUE shall reimburse all sums paid to the exclusion of any form of compensation, within a fourteen-day period following the cancellation of the order.
10.5 Delivery charges
The delivery charges for the Products are indicated on the website for each order, as well as in the order confirmation email sent by AVENTURE NORDIQUE to the Customer. Delivery charges vary according to the nature of the Products to be delivered (size, weight, etc.), the delivery method and the delivery address.
10.6 Transport
All risks of loss or damage to the Product are transferred to the Customer when the Customer or a third party designated by the Customer takes physical possession of the Product.
When the Customer receives the order, the Customer is required, in the presence of the carrier, to check that the Products delivered match the order, to inspect the condition of the package (damage, open package, missing or damaged products, torn security tape, etc.) and to note any complaints on the delivery note, in handwriting accompanied by their signature.
In parallel, and without prejudice to the applicable statutory warranties, the Customer must send any complaints regarding the non-conformity of products existing on the delivery date by email as soon as possible to AVENTURE NORDIQUE : info@aventurenordique.com
ARTICLE 11: Statutory Warranty of Conformity
11.1 The implementation of the warranty
All Products on sale on the website are covered by the statutory warranty of conformity and the warranty against hidden defects (due to a defect in material, design or manufacture affecting the products and rendering them unfit for purpose) entitling the Customer to return products delivered that are faulty or non-compliant.
AVENTURE NORDIQUE shall be liable for any defects in conformity that appear within a period of twenty-four (24) months from the delivery of the goods.
In the event of proven non-conformity, the Customer shall have the choice between the repair or replacement of the Product, unless the option chosen involves a cost that is clearly disproportionate in comparison to the other option, given the value of the Product or the size of the defect.
If it is impossible to repair or replace the Product, AVENTURE NORDIQUE shall refund the Customer the price of the Product upon return or offer the Customer a reduction in the price paid and the Customer shall retain the Product.
This warranty does not cover Products which have been damaged by the Customer as a result of an accident or misuse, negligence or poor maintenance by the Customer, or normal wear and tear of the product. If the Product is damaged by the Customer and is not due to a manufacturing defect, the Customer shall pay the transport costs for returning the product as well as the repair costs.
11.2 Methods of return
A Customer who wishes to return a Product under the statutory warranty of conformity must inform AVENTURE NORIDIQUE by sending an email to the following email address: info@aventurenordique.com
ARTICLE 12: The Right to Withdraw
A Customer who wishes to return a Product under the statutory warranty of conformity must inform AVENTURE NORIDIQUE by sending an email to the following email address : info@aventurenordique.com
12.1 Deadlines and products concerned
The Customer has a period of fourteen (14) days to state that they wish to return a Product which is unsuitable, without having to give a reason for this decision. This period begins from the date of receipt of the Product by the Customer or a third party designated by the Customer, other than the carrier.
For orders consisting of several Products delivered separately, the period begins from the receipt of the last Product.
12.2 Special case: no right to withdraw
The right to withdraw does not apply to the following orders:
Products offered for sale by AVENTURE NORDIQUE if they are made according to the customer's specifications or are clearly tailored to the customer's needs. For example, this is the case for orders of a pair of skis with ski bindings to be fitted by AVENTURE NORDIQUE.
Products offered for sale by AVENTURE NORDIQUE that have been unsealed by the customer after delivery and which cannot be returned for reasons of hygiene or health protection, such as:

hygiene and body care products, including soaps, shampoos, deodorants, toothpastes, toothbrushes, sunscreens, razors, wipes, etc.
food and nutrition products that have been opened by the consumer, including freeze-dried meals, energy bars, energy purees, dried meats, etc.
12.3 Methods of exercising the right to withdraw
To exercise the right to withdraw, the Customer must inform AVENTURE NORDIQUE of this decision in a clear, express declaration:

Either online by completing the form on the website provided for this purpose;

Or by completing and returning to AVENTURE NORDIQUE the form attached hereto;

Or by postal letter to the following address: AVENTURE NORDIQUE, 586 Route de Villard 38250 Lans-en-Vercors France.
If the Customer chooses one of the first three options, AVENTURE NORDIQUE shall promptly send the Customer an acknowledgement of receipt of the withdrawal by email.
Customers must send their request before the end of the aforementioned withdrawal period in order for the withdrawal period to apply.
12.4 Product returns
The Product must be returned in its original packaging to AVENTURE NORIDIQUE without undue delay and, in any event, no later than fourteen (14) days from the notification of the decision to withdraw. The address for returns is as follows:

The Customer can be held liable to AVENTURE NORDIQUE if the Product is impaired due to handling other than what is required to ascertain the nature, characteristics, and correct operation of the Product.
The Products must be returned:

undamaged and complete, i.e. in their original packaging.

unspoiled and unsoiled in conditions not exceeding simple trial use.
-
with their instructions for use.
The Customer is responsible for paying the direct costs of returning the Product.
12.5 Refund if the right to withdraw is exercised
In the event of withdrawal by the Customer, AVENTURE NORDIQUE will refund all sums paid by the Customer, including the charges for delivering the Product to the Customer (except for additional costs due to the Customer's choice of a more expensive delivery method than the standard delivery method offered by AVENTURE NORDIQUE), no later than fourteen (14) days from the date on which AVENTURE NORDIQUE is informed of the Customer's decision to withdraw.
The Customer is informed that AVENTURE NORDIQUE can postpone the refund until it has received the returned Product or until the Customer has supplied proof of shipment of the Product, whichever is the earlier. The Customer is therefore responsible for keeping proof of shipment.
AVENTURE NORDIQUE will make the refund using the same means of payment as the Customer used for the initial transaction.
ARTICLE 13: Intellectual Property Rights
AVENTURE NORDIQUE holds the intellectual property rights or has acquired the rights allowing it to use the website, trademarks, designs, models, images, texts, photos, logos, style guides, software, search engines, etc. appearing on the website.
In the same way, AVENTURE NORDIQUE holds the intellectual property rights to the Products proposed for sale on the site, in particular the designs, models, logos, and names represented.
These General Terms and Conditions of Sale do not entail any transfer of any kind of intellectual property rights to all or part of the above elements to Customers.
Any reproduction and/or representation, either in whole or in part, of any of these elements without AVENTURE NORDIQUE's express authorisation is prohibited and constitutes copyright infringement.
ARTICLE 14: Liability
AVENTURE NORDIQUE cannot be held liable for the non-execution of an order due to force majeure, the actions of a third party or the actions of the Customer.
ARTICLE 15: Personal Data
The information which is asked for on the website is required to process the order.
The recipients of the data are AVENTURE NORDIQUE's internal services as well as the carrier and/or logistics provider used by AVENTURE NORDIQUE.
In accordance with the French Data Protection Act, Customers are informed that they have the right to question, access, modify and rectify data by sending an email to the following address: info@aventurenordique.com
and that they also have a right to object, for legitimate reasons. AVENTURE NORDIQUE stores data for the period of time that is strictly necessary for the purpose of processing.
ARTICLE 16: Conservation
AVENTURE NORDIQUE shall archive the written record of a Customer order of an amount greater than or equal to one hundred and twenty (120) euros for a period of ten (10) years from the delivery of the Product that was the subject of the order.
The contracts shall be archived in electronic format.
The Customer can access this written record at any time during this period by sending a request to the following address : info@aventurenordique.com
ARTICLE 17: Invalidity
If one or more provisions of these General Terms and Conditions of Sale are held to be invalid or declared as such in accordance with a law or regulation, or as a result of a final judgement by a court with competent jurisdiction, the other provisions shall remain in full force and effect.
ARTICLE 18: Law
The Contract is governed by French law, both with regard to the rules of substantive law and the rules of procedural law.
ARTICLE 19: Mediation service
In the case of a dispute that has not been settled by an amicable agreement, and which has been the subject of a written complaint sent by a Customer to AVENTURE NORDIQUE, the dispute can be submitted to the consumer ombudsman, whose contact details are as follows:
